By accessing or using the services of creativemal, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, you must not access or use our services. These terms constitute a legally binding agreement between you and creativemal.
You must be at least 13 years of age to use our services. If you are between 13 and 18 years of age, you represent that you have your parent's or guardian's permission to use our services and that they have reviewed and agreed to these terms on your behalf.
Services Description
creativemal provides non-academic tutoring services focused on skill development and personal growth. Our services include personalized instruction, learning materials, and progress tracking tailored to individual learning objectives.
User Responsibilities
Users are responsible for:
- Providing accurate and complete information when registering for services
- Timely payment of all fees associated with their chosen package
- Attending scheduled sessions or providing adequate notice for cancellations
- Maintaining respectful and professional conduct during all interactions
- Keeping account credentials secure and confidential
Payment Terms
All fees are due in advance according to the selected package. Payments are processed through secure third-party payment processors. Package subscriptions are billed monthly and will automatically renew unless cancelled. Users may upgrade, downgrade, or cancel their subscription at any time.
Cancellation and Refunds
Sessions must be cancelled at least 24 hours in advance. Late cancellations may be subject to fees. Subscription cancellations take effect at the end of the current billing period. Refund requests are evaluated on a case-by-case basis in accordance with our Return Policy.
Intellectual Property
All content, materials, and resources provided through our services, including but not limited to learning materials, methodologies, and proprietary content, are the intellectual property of creativemal and are protected by copyright and other intellectual property laws.
Limitation of Liability
CREATIVEMAL PROVIDES TUTORING SERVICES FOR EDUCATIONAL AND SKILL DEVELOPMENT PURPOSES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING SPECIFIC OUTCOMES, RESULTS, OR GUARANTEES OF SUCCESS. OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
IN NO EVENT SHALL CREATIVEMAL, ITS INSTRUCTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID FOR SERVICES WITHIN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN YOUR STATE.
Modifications to Terms
We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.
